Artiforia Terms of Service

These Terms govern your access to and use of artiforia.com and our products. By visiting or purchasing, you agree to these Terms.

1) Acceptance of Terms

Welcome to Artiforia (“Artiforia,” “we,” “us,” or “our”). These Terms of Service (“Terms”) apply to your use of artiforia.com, our related websites, and any purchases of our products (collectively, the “Services”). By accessing the Services, creating an account, or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Services.

For convenience, headings are provided only for structure and do not limit any provision.

2) Eligibility & Nature of Products

You must be at least the age of majority in your jurisdiction (18 in most locations) and capable of forming a binding contract to use the Services or purchase products. By using the Services, you represent and warrant that you meet these requirements.

Nature of Products: Artiforia sells collectible display art inspired by whiskey bottle forms. We do not sell alcoholic beverages. Products are decorative items only.

3) Accounts

To access certain features, you may create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of unauthorized use. We may suspend or terminate accounts that violate these Terms.

4) Orders, Pricing & Payment

  • Order Acceptance: Your order is an offer to buy; we may accept or reject any order at our discretion (e.g., limited inventory, suspected fraud, pricing or listing errors).
  • Pricing & Taxes: Prices are shown in the currency indicated and exclude applicable taxes, duties, and shipping unless stated otherwise. You authorize us to charge your selected payment method for the total amount.
  • Promotions: Discounts or offers are subject to terms stated at the time and may not be combined unless expressly allowed.
  • Pre-Orders / Limited Runs: Estimated ship windows are provided for convenience and may change. We will notify you of significant delays or cancellations and provide options.
  • Fraud Prevention: We may require additional verification before accepting or shipping an order.

5) Shipping & Risk of Loss

We ship to the destinations listed at checkout. Shipping times are estimates and not guarantees; carrier delays and customs inspection may extend delivery times.

Risk of Loss: Title and risk of loss pass upon delivery to the shipping address you provide. If a parcel shows as delivered but you cannot locate it, contact the carrier and our team for assistance.

6) Returns, Exchanges & Refunds

We want you to love your piece. Eligible items may be returned within 30 days of delivery in original condition and packaging. Start a return via Shipping & Returns or email support@artiforia.com.

  • Returned items must be securely packaged to prevent damage in transit.
  • Refunds are issued to the original payment method after inspection.
  • Original shipping fees may be non-refundable unless required by law.
  • If your item arrives damaged, contact us within 7 days with photos so we can assist with replacement or refund.

7) Product Information

We strive for studio-true color in our photography. Actual colors may vary slightly due to device displays and ambient lighting. Dimensions and finishes may vary slightly within normal tolerances for handcrafted items.

Trademarks: Unless expressly stated on the product page, Artiforia is not affiliated with or endorsed by third-party brands or teams referenced as artistic inspiration. All trademarks remain the property of their respective owners.

8) Intellectual Property

The Services, including all content, images, designs, logos, and trademarks (collectively, “Artiforia Content”), are owned by Artiforia or its licensors and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. Any other use requires prior written consent.

9) User Content & Reviews

If you submit photos, reviews, or other content (“User Content”), you grant Artiforia a worldwide, royalty-free, perpetual license to host, display, reproduce, and create derivative works from such content in connection with the Services and marketing, in any media now known or later developed. You represent that you own or have permission to use and license that content and that it does not infringe any third-party rights.

10) Prohibited Activities

  • Using the Services for unlawful purposes or in violation of any law or regulation.
  • Infringing, misappropriating, or violating intellectual property or privacy rights.
  • Attempting to interfere with the security or integrity of the Services, including scraping, reverse engineering, or introducing malware.
  • Deceptive, fraudulent, harassing, or harmful conduct.

11) Third-Party Services & Links

The Services may include links to third-party sites, apps, or tools (e.g., payment processors, carriers). We are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and governed by their terms.

12) Disclaimer of Warranties

The Services and products are provided “as is” and “as available” to the fullest extent permitted by law. Artiforia disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation of the Services.

13) Limitation of Liability

To the maximum extent permitted by law, Artiforia and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, arising from or related to your use of the Services or purchase of products. In all cases, our total liability shall not exceed the amount you paid to Artiforia for the product(s) giving rise to the claim.

Some jurisdictions do not allow certain limitations; these may not apply to you to the extent prohibited by law.

14) Indemnification

You agree to defend, indemnify, and hold harmless Artiforia from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your violation of these Terms or your use of the Services.

15) Governing Law & Jurisdiction

These Terms and any disputes arising out of or relating to them are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware for all disputes not subject to consumer protection exceptions under applicable law.

If you are a consumer located outside the U.S., you may have additional mandatory rights and remedies under your local laws; these Terms do not limit such rights.

16) Changes to the Services or Terms

We may update the Services and these Terms from time to time. Material changes will be posted on this page with an updated date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.

17) Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions will remain in full force.
  • No Waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
  • Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or sale of assets.
  • Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
  • Entire Agreement: These Terms, together with policies linked here, constitute the entire agreement between you and Artiforia regarding the Services.
